1. Agreement
These Terms of Use ("Terms") are an agreement between you and Happy Computers, the developer of yave ("yave," "we," "us," or "our"). They govern your access to and use of the yave website, browser-based video editor, APIs, and related services (together, the "Services").
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. The yave service
yave is a non-linear video editor that runs in the browser. Depending on the features available to you, yave lets you import footage, audio, and images; organize projects; edit a timeline manually; search indexed media; ask an optional agent to help make edits; and render or export a finished file in the browser.
Some features are local-first. Source files and file handles may remain on your device. Optional cloud media storage, project backup, media indexing, and agent features require sending the relevant content or project data to the services needed to provide those features.
3. Eligibility and accounts
You must be legally able to enter into these Terms. If you use yave for an organization, you represent that you have authority to bind that organization.
Some Services require an account. You sign in with Google. You are responsible for keeping your account information accurate, protecting your credentials, and all activity under your account. Tell us promptly if you believe your account has been accessed without permission.
4. Your content
You keep ownership of the videos, audio, images, project files, prompts, instructions, and other material you submit or create through yave ("Your Content"). You are responsible for Your Content and for having all rights, permissions, and consents needed for us to process it through the Services.
You grant us a limited, worldwide, non-exclusive license to host, copy, transmit, process, and display Your Content only as needed to operate, secure, maintain, and provide the Services you request, including editing, rendering, backup, search, indexing, and agent features. This license ends when the relevant processing or account relationship ends, except where retention is required by law or needed for security, dispute resolution, or legitimate backups.
5. Agent and automated features
yave may use automated and AI-assisted features to search media, interpret instructions, suggest changes, or apply edits. These features can be wrong, incomplete, or unavailable. Review every suggested or applied change before relying on an export or sharing it with others.
Agent responses are not professional, legal, financial, or safety advice. We do not promise that an agent will understand your intent, preserve every creative choice, or produce a particular result.
6. Acceptable use
You may not use the Services to:
- break the law, violate another person's rights, or distribute harmful material;
- upload material you do not have permission to use;
- interfere with the Services, bypass access controls, or probe their security;
- reverse engineer, scrape, copy, or resell the Services without permission;
- upload malware or use the Services to attack, surveil, or deceive others; or
- attempt to access another person's account, project, media, or data.
We may limit or suspend access when reasonably necessary to protect users, the Services, or third parties, or to comply with law.
7. Third-party services
yave may rely on or link to third-party services, including authentication providers, cloud storage, hosting, model providers, and media-indexing providers. Their terms and privacy policies apply to their services. We are not responsible for third-party services that we do not control. A third-party link does not mean that we endorse that service.
8. Ownership of yave
The Services, including their software, visual design, text, trademarks, and underlying technology, belong to yave or its licensors. We give you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services while you comply with these Terms. No other rights are granted.
9. Refund policy
We may offer a full refund for a subscription only when both of the following conditions are met: the subscription has been active for fewer than seven days, and usage is less than 10%.
Refund requests that do not meet both conditions are considered case by case and are not guaranteed. To request a refund, contact us at amaan@poke.com.
10. Changes, suspension, and termination
We may change, pause, or discontinue all or part of the Services. We may also update these Terms. If a change materially affects your rights, we will take reasonable steps to notify you. Continued use after an updated version is posted means that you accept the updated Terms.
You may stop using yave at any time. We may suspend or terminate access if you materially breach these Terms, create risk for the Services or others, or if we are required to do so. Sections that should reasonably survive termination will survive, including those concerning Your Content, ownership, disclaimers, and liability.
11. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided "as is" and "as available." We make no warranties that the Services will be uninterrupted, secure, error-free, or fit for a particular purpose, or that edits, searches, agent results, or exports will be accurate or meet your requirements.
To the fullest extent permitted by law, yave and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business arising from or related to your use of the Services. Our total liability for claims relating to the Services will not exceed the greater of US$100 or the amount you paid us for the Services in the twelve months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or takes away rights that applicable law gives you.
